  7. This file puts forward the terms by which Noch Software permits other 
  8. parties to distribute this program.

  11. 1. Distribution by modem:

  13. All BBS and online services may distribute the Fortune Cookie by modem 
  14. as long as no files are altered or removed.  If a distribution fee is 
  15. charged for the game, you must ensure that:

  17. -  Noch Software is credited as the publisher of the game.
  18. -  The program is identified as shareware.
  19. -  You charge less than $9 for downloading it.

  22. 2. CD-ROM:

  24. You must obtain written permission from Noch Software in order to put
  25. this game on a CD-ROM, or to sell it as part of a package that contains 
  26. more than one game.

  28. 3. Distribution in retail stores:

  30. You must obtain written permission from Noch Software in order to sell
  31. this game in retail stores.

  33. 4. Bundling with hardware:
  34.  
  35. You may bundle Fortune Cookie shareware edition with new hardware as long 
  36. as you don't modify or delete any program files, and as long as you provide 
  37. the shareware programs free of charge to the user when the hardware is 
  38. purchased.

  41. 5. Violation of the agreement:

  43. If you distribute this program in violation of the terms of this agreement,
  44. you will be liable to Noch Software for damages of not less than $1 per copy
  45. distributed or the registration fee (whichever is greater.)

  47. 6. Other terms and conditions:

  49. - Except as expressly licensed by Noch Software, we have and reserve 
  50.   the exclusive copyright and all other rights, title and interest to 
  51.   distribute this program.

  53. - Your right to distribute under this license is personal, and does not
  54.   include any right to sublicense the Program.

  56. - THIS PROGRAM IS PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND EITHER
